Arbitration Fees

Even if the Arbitration Associates provided arbitration procedures for free, arbitrations are still expensive considering the attorney’s fees that are necessary to prepare for and participate in the arbitration. Since the parties are investing significant funds in the arbitration, not counting the fee of the arbitrator, it stands to reason that efforts should be made to choose an arbitrator that gives the parties the best chance for a successful and fair resolution of the dispute. On the other hand, the parties do not want to pay for more arbitration than needed. In light of these considerations, Arbitration Associates has set its fees to reflect flexibility and reasonableness.
 

Arbitration
The basic fee for a non-reasoned arbitration is $3,000.00. This fees includes review of the Complaint and Response; pre-trial hearing; any pre-trial legal research pertaining to disputed issues of law; scheduling of and conducting the pre-arbitration hearing; one day of testimony; review of documentary evidence; legal research pertaining to any legal issues raised by the evidence; deliberation of the evidence; and preparation of the arbitration award and transmittal to the parties. If the arbitration requires more than one day of evidence, an additional fee of $2,000.00 per four hour period will be incurred. Each day of evidence will begin at 9:00 a.m. and end at 6:00 p.m. with a one-hour lunch period. Each party will be responsible for paying his/her proportionate share of this fee into the Arbitration Associates trust account at the time Arbitration Associates is engaged. If a decision is made not to go forward with the evidence stage of the arbitration hearing, all funds deposited into the Arbitration Associates trust account will be refunded, except for $1,500.00. The fee for a reasoned opinion is $1,500.00 in addition to other incurred fees.
 

Post Mediation Arbitration
The basic fee for a half day post mediation arbitration is $1,000.00, split between the parties. The fee for full day post mediation arbitration is $2,000.00, split between the parties.
 

Consumer Arbitration
The flat rate for a consumer arbitration is $500, of which, $100 is to be paid by the consumer.
 

Weekend Arbitrations
Arbitration Associates is available for weekend arbitrations. There is no additional charge for weekend arbitrations. 
 

Cancellation/Rescheduling
If a party needs to reschedule the arbitration hearing, there will be no fee assessed as long as Arbitration Associates is notified at least 72 hours prior to the scheduled arbitration. If arbitration is canceled due to Court Order or settlement, there will be no cancellation charge. If the arbitration is canceled for any other reason, there will be a $200.00 cancellation fee which may be waived under extenuating circumstances.
 

Administration Fees
Unlike other arbitration services, Arbitration Associates does not charge administration fees. Some arbitration organizations charge these administration fees for providing administrative services   in addition to the rate for the arbitration. For example, a well known national arbitration service charges administration fees based on the amount of the claim or counterclaim; their administration fees start at $950 and can be over $18,500 for a multi-million dollar claim. At Arbitration Associates all cost, including administration costs, are included in our rates.
